Subchapter 004 – Forest Fires and Fire Prevention
(a) Permit Required
No person shall kindle an open-air fire to burn natural wood, brush, weeds, or grass without permission from the town forest fire warden.
- Permit must specify when and where the fire is allowed
- Written “Permit to Kindle” issued within 12 hours
- No burning of treated materials (painted, stained, etc.)
(b) Burn Ban Authority
During high fire risk periods:
- Commissioner may suspend all permits
- Fire wardens must not issue permits
(c) Exceptions
- Snow surrounding burn site
- Stone fireplaces, arches, or fire rings
- Fires 200+ ft from woodland or dry vegetation
- Cities with fire departments
(d) Definitions
Natural wood includes:
- Trees (logs, trunks, limbs, stumps)
- Lumber and timber
- Untreated pallets
Does NOT include:
- Sawdust
- Plywood
- Particle board
(e) Air Quality Authority
Air pollution officials may still prohibit burning under separate regulations.
